These Terms and Conditions govern the provision of chauffeur services by Eclipse Chauffeurs Pty Ltd (ABN 71 695 019 802) trading as Eclipse Chauffeurs (“Eclipse Chauffeurs”, “we”, “us”, “our”). By making a booking with us, you (“the Client”) agree to be bound by these terms.
1. Our services
Eclipse Chauffeurs provides premium chauffeur services in Victoria, including Airport Transfers, Point-to-Point transfers, and Hourly Hire, using our Mercedes-Benz S-Class fleet operated under Commercial Passenger Vehicle accreditation.
2. Bookings
Bookings may be made by phone, email, our website, or through our booking platform. A booking is only confirmed once you receive written or system confirmation from us. It is the Client’s responsibility to ensure all booking details, including pickup location, time, and flight information, are accurate.
3. Fares and payment
Fares are quoted in Australian dollars and are inclusive of GST unless stated otherwise. Airport Transfer fares are fixed and all-inclusive of tolls, airport access, and applicable Commercial Passenger Vehicle levies. Point-to-Point and Hourly Hire fares are calculated in accordance with our published pricing structure at the time of booking. Payment is due as specified at the time of booking or invoicing, and may be processed through our nominated payment provider.
4. Waiting time
A period of free waiting time is included depending on service type. Waiting time beyond the included period will be charged at our published rate. Details of applicable free waiting periods are available on request or at the time of booking.
5. Surcharges
Surcharges may apply for after-hours bookings and public holidays, in accordance with our published pricing structure. No surcharge applies on weekends.
6. Cancellations and no-shows
Cancellation charges apply in accordance with our Cancellation Policy, published separately and available on request or on our website. By making a booking, the Client agrees to the terms of our Cancellation Policy.
7. Passenger conduct and vehicle use
Clients and passengers are expected to treat our vehicles and chauffeurs with respect. We reserve the right to refuse or terminate service, without refund, where a passenger’s conduct poses a risk to the safety of the vehicle, chauffeur, or other passengers, or involves illegal activity. Smoking, vaping, and the consumption of illicit substances are not permitted in our vehicles.
8. Luggage and capacity
Vehicles are operated within manufacturer passenger capacity and reasonable luggage limits. Clients should advise us of unusual luggage requirements at the time of booking to ensure the vehicle can accommodate the request.
9. Lost property
Eclipse Chauffeurs will make reasonable efforts to return property left in a vehicle, but accepts no liability for items lost, damaged, or left behind during a trip. Clients should contact us as soon as possible to report lost property.
10. Liability
To the maximum extent permitted by law, Eclipse Chauffeurs’ liability for any loss, damage, delay, or injury arising from our services is limited to the resupply of the relevant service, or the cost of that resupply. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on the Client under the Australian Consumer Law, or any other applicable law, that cannot lawfully be excluded, restricted, or modified.
Eclipse Chauffeurs is not liable for delays or failures to perform caused by circumstances beyond its reasonable control, including traffic, weather, flight delays, or road closures, though we will take reasonable steps to minimise the impact of such events on the Client.
11. Force majeure
Eclipse Chauffeurs will not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to extreme weather, natural disaster, government restrictions, or vehicle mechanical failure that could not reasonably have been prevented.
12. Privacy
Our handling of personal information is set out in our Privacy Policy, available on our website, which forms part of these terms.
13. Complaints
Any complaints regarding our services should be directed to office@eclipsevip.com.au. We will investigate and respond to complaints in a timely manner.
14. Governing law
These terms are governed by the laws of Victoria, Australia, and the Client submits to the non-exclusive jurisdiction of the courts of Victoria.
15. Changes to these terms
Eclipse Chauffeurs may update these Terms and Conditions from time to time. The version in effect at the time of booking will apply to that booking.
